REFUND, CANCELLATION, AND TECHNICAL LIABILITY POLICY

1. GENERAL REFUND AND CANCELLATION PRINCIPLE
Due to the immediate digital nature of the educational evaluation software, simulation data feeds, and proprietary dashboard access provided by Wildfunded, owned and operated by Horux Media FZCO (the Company), all purchases represent the acquisition of a non-tangible digital license governed by a strict general no-refund policy.
THE USER EXPRESSLY ACKNOWLEDGES AND AGREES THAT:
a) Immediate Digital Service Fulfillment: All Services, simulation access credentials, software allocations, and third-party data feed reservations are deemed FULLY DELIVERED, CONSUMED, AND ACTIVE at the precise timestamp access credentials or portal account access are generated and transmitted to the User registered email address or made accessible within the User private account dashboard. Provision of access credentials via the User dashboard constitutes conclusive technical proof of service delivery under payment card network standards.
b) Non-Refundable Access Fees: The fees paid by the User represent a single, non-recurring fee for access to proprietary evaluation software and digital infrastructure. Once credentials or dashboard access have been generated, fees are non-refundable, regardless of whether the User chooses to log in, operates the simulated account, leaves the account inactive, or experiences personal technical limitations.
c) Traded Accounts: Once any simulated trading activity (placement of at least one simulated order) has been initiated within the virtual environment, the User explicitly waives any right to claim a refund, credit, or balance adjustment under any circumstances.
d) Express Waiver of Statutory Right of Withdrawal: By completing a purchase, selecting the mandatory checkout agreement checkboxes, and accessing the Platform, the User explicitly requests and consents to the immediate performance and fulfillment of the digital content prior to the expiration of any statutory cooling-off period, and acknowledges that they thereby expressly waive any statutory right of withdrawal, refund, or cancellation under applicable consumer protection regulations.
2. EXCEPTIONAL REVIEW AND COMPANY GOODWILL COMMITMENT
Notwithstanding Section 1, Horux Media FZCO is committed to operating with commercial fairness and in good faith.
a) Non-Receipt of Credentials Window: The User is granted a twenty-four (24) hour window from the timestamp of purchase to report non-receipt of access emails or login credential delivery failures to support@wildfunded.com. Failure to report non-receipt within this window, or accessing credentials directly via the User dashboard, constitutes conclusive legal proof of successful digital service delivery.
b) System Error Cure Commitment: If a User experiences a demonstrable system error, billing glitch, or technical failure caused strictly by the Company proprietary infrastructure, the User must submit a formal technical error report to support@wildfunded.com within seven (7) calendar days of the occurrence.
c) Duplicate Charges Remediation: In the event of an accidental duplicate transaction charge caused by payment gateway processing errors, the User must notify support@wildfunded.com within seventy-two (72) hours. Upon verification that no simulated trading has occurred on the duplicate account, the Company will process a full refund for the duplicate transaction.
d) Discretionary Remediation: Upon verifying any technical anomaly, the Company reserves the right, at its sole discretion, to cure the defect by issuing a replacement simulated evaluation account, restoring account credentials, or issuing a full or partial refund.
e) Voiding of Eligibility: Refund eligibility or goodwill account replacement is completely void if the account has been suspended, disqualified for breaching evaluation parameters, involved in prohibited trading practices (as defined in Section 5 of the Terms of Use), or if the User fails mandatory KYC/AML screening.
3. EXCLUSION OF LIABILITY FOR ISOLATED TECHNICAL ISSUES
While Horux Media FZCO endeavors to maintain commercially reasonable uptime for its simulation environment, the Company shall be completely exempt from any liability, whether in contract, tort, strict liability, or otherwise, for any losses, damages, costs, or financial obligations arising from or in connection with isolated technical issues experienced individually by a User.
Without limiting the generality of the foregoing, this exclusion of liability encompasses, but is not limited to:
a) Individual disruptions, software malfunctions, feed latency, or execution discrepancies in simulated data transmissions or trading platform interfaces.
b) Specific errors, system failures, latency gaps, or outages within third-party trade duplication software (trade copiers).
c) Defects, anomalies, or performance failures tied to third-party applications, including automated trading bots (Expert Advisors), custom indicators, or external software scripts utilized by the User.
d) Platform instability, disconnections, or network failures resulting from the quality, speed, or security of the User local internet connection, hardware components, or network service providers.
e) Slippage phenomena (positive or negative), spread widening, or execution gaps triggered by scheduled or unscheduled macroeconomic news releases, periods of extreme market volatility, or weekend holding windows.
The Company is under no obligation to grant refunds, balance adjustments, credits, or financial compensation for such occurrences. It is the sole responsibility of the User to guarantee the stability, functionality, and security of their personal technological infrastructure.
4. POLICY ON CHARGEBACKS, PAYMENT DISPUTES, AND FRAUDULENT CLAIMS
By purchasing access to Wildfunded Services, the User formally commits not to initiate improper chargebacks, payment disputes, or claims of unauthorized transaction with their banking institution, credit card issuer, or payment processor (including, but not limited to, Stripe, Payoneer, dLocal, EBANX).
a) Mandatory Informal Administrative Review: Prior to filing any formal payment dispute or chargeback, the User agrees to submit a written Notice of Dispute to support@wildfunded.com detailing the operational or billing grievance. The Company shall be granted a mandatory sixty (60) day administrative period from receipt of the Notice to investigate, evaluate, and attempt an amicable resolution (Cure Period).
b) Unjustified Dispute Classification: Opening a payment dispute or chargeback for an account where access credentials have been transmitted or made available via dashboard, or where simulated trading has occurred, shall be classified as groundless, fraudulent, and a bad-faith breach of this Agreement.
c) Enforcement Measures: In the event of an improper or fraudulent chargeback:
The offending User will be permanently banned, forfeiting all current and future access to all Wildfunded environments, accounts, and tools.
The Company is explicitly authorized to submit complete digital audit trails—including IP access logs, device fingerprints, timestamped credential delivery receipts, dashboard telemetry logs, KYC records, checkout agreement logs, and simulated trading activity reports—to the payment processor, acquiring bank, card network (under Visa Compelling Evidence 3.0 standards), or investigating entity to demonstrate complete digital service fulfillment.
Pursuant to Section 16 of the Terms of Use, the Company reserves the right to seek full recovery of disputed funds, direct payment gateway chargeback administrative fees, operational costs, and reasonable legal counsel fees through judicial proceedings, arbitration, or debt collection agencies under United Arab Emirates law.
d) Consent to Evidence Disclosure: The User explicitly authorizes the Company to transmit all transaction, identity, IP address, device telemetry, and platform usage data to financial institutions and card networks for the express purpose of defending against payment disputes and friendly fraud.
5. LIMITATION OF FINANCIAL LIABILITY AND GOVERNING LAW
a) Maximum Liability Cap: To the maximum extent permitted by applicable law, the total cumulative financial liability of Horux Media FZCO for any claims, losses, or damages arising out of or related to this Refund Policy or the Services shall under no circumstances exceed the actual amount paid by the User to the Company for the specific Service giving rise to the claim, or one hundred US dollars ($100.00 USD), whichever is lower.
b) Base Currency: All refund calculations, dispute evaluations, and liability thresholds are defined and processed strictly in United States Dollars (USD). The Company bears no liability for foreign exchange fluctuations, bank conversion fees, or local currency devaluations.
c) Conflict Resolution: This Refund and Liability Policy complements and shall be read strictly in conjunction with the Terms of Use. In the event of any discrepancy between this Policy and the Terms of Use, the Terms of Use shall prevail and govern in all respects.
d) Severability of Provisions: If any provision, clause, or limitation of this Policy is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
e) Governing Timestamp: The version of this Policy active at the precise timestamp of transaction completion shall govern that specific purchase in perpetuity.
